The Victorian government has done the unthinkable: a male who raped his own five-year-old daughter is serving his sentence in a women’s prison. His “gender identity” was treated not only as justification for placing him among vulnerable women, but also as a mitigating factor that reduced his jail term.
This is not just a shocking story of judicial leniency – it is a stark warning about the failures of Australia’s sex discrimination and self-identification laws.
For decades, women fought to secure single-sex protections in prisons, shelters, sport, and services. These protections recognised that women – biological females – are uniquely vulnerable to male violence. But in the past decade, a wave of legislative and policy changes has rewritten those protections, replacing sex with “gender identity.”
Under the Sex Discrimination Act 1984, amended in 2013, “gender identity” is now a protected attribute. State governments, including Victoria, New South Wales, Tasmania and the ACT, have adopted “self-ID” policies. That means a male need only declare himself a woman to gain access to female single sex spaces.
The consequences are now in front of us.
In Victoria, a pedophile who created child sexual abuse material of his own daughter was allowed to claim that his gender dysphoria reduced his “moral culpability.” Incredibly, this was accepted by the judge, who imposed a sentence of just four years and nine months, with a non-parole period of two and a half years. For abusing a child, the maximum penalty is 25 years.
This leniency is not an act of compassion. It is a betrayal of women, children, and justice itself.
Women’s prisons house some of the most vulnerable people in our society, many are survivors of male sexual abuse. To force them to share living quarters with a convicted male sex offender is unconscionable. It re-traumatizes women, strips them of safety, and sends the message that their rights are negotiable.
Women’s groups have raised the alarm repeatedly. Women’s Forum Australia has warned that this case sets a dangerous precedent, creating a loophole where male offenders can obtain lighter sentences and access women’s prisons simply by identifying as female. Sall Grover, the founder of the women’s app Giggle, has put it plainly: “If you set the precedent that these horrible people can basically get lighter sentences by making this claim, you’ve created the loophole for them.”
Australia is now behind the international curve. The United Kingdom has tightened its policies after repeated scandals involving male offenders placed in women’s jails. Scotland rolled back its self-ID law after public outcry when violent men were transferred to female facilities. Yet in Australia, state governments are doubling down, silencing critics, and hiding behind “inclusion” while women’s safety is sacrificed.
This must end.
The Sex Discrimination Act must be amended to make clear that sex-based protections cannot be overridden by gender identity. Self-identification policies in prisons must be scrapped. Vulnerable male prisoners who fear for their safety should be accommodated in secure facilities within the men’s estate, not housed with women. And sentencing judges must stop treating gender dysphoria as an excuse to reduce accountability for crimes of sexual violence.
Australia’s leaders need to hear a simple truth: women are not collateral damage in the culture wars. Our spaces, our protections, and our rights are not bargaining chips for political convenience.
The public should be outraged that a child rapist is sitting in a women’s prison today. But outrage is not enough. We must demand urgent legislative reform, ministerial accountability, and a return to the principle that women’s safety comes first.
Anything less is complicity in injustice.
